Online Chair Yoga Class Waiver

Please read this waiver carefully before participating in SOULESTA® Living’s online chair yoga class series (“Class.”)

Health Disclaimer:

• You acknowledge that you are in good health and physically able to participate in this Class.
• You agree to consult with your doctor before starting any new exercise program, especially if you have any existing medical conditions.

Instructional Disclaimer:

• You acknowledge that the instructor provides general yoga instruction and may not be able to tailor the class to your specific needs or limitations.
• You agree to listen to your body and modify poses as needed.

Liability Disclaimer: No Professional Advice and Earnings Disclaimer: 

• The information contained in or made available by the SOULESTA® Living or any third-party through the Class of their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal, fields.  SOULESTA® Living does not offer any professional personal, medical, financial, or legal advice. 
• Neither SOULESTA® Living, nor their assigns, sponsors, speakers, partners, contractors, or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary, or other damages to the Attendee or the Attendee’s business including economic loss that may result from participation in the Class or from the use of, or the inability to use, the materials information, or strategies communicated through the Class or any products or services provided pursuant to the Class, even if advised of the possibility of such damages. 
• Under no circumstances, including but not limited to negligence, will SOULESTA® Living be liable for any special or consequential damages that result from Attendee’s participation in the Class.  These statements are simply our opinion.  No guarantees are made that you will achieve any results from our ideas or models presented in the Class, and we offer no professional legal, psychological or financial advice.

Assumption of Risk:

By participating in this Class, you acknowledge and understand the following:

• Chair yoga involves physical movement and may pose a risk of injury.
• You are voluntarily participating in this class at your own risk.
• You assume full responsibility for any injuries or health problems that may occur as a result of your participation.

Liability Waiver:

While we take every possible measure to ensure the safety of every attendee in the Class, the Attendee is legally responsible for their safety and behavior and agrees, to, and is held legally liable to the following statements.

I, the willing Attendee of the Class, hereby accept all risk to my health and of my injury or death that may result from participating in the Class and I hereby release SOULESTA® Living, and their officers, employees, intern, contractors, sponsors, and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for including my death, that may result from or occur during my participation in the Class, whether caused by negligence of the SOULESTA® Living, and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent of intentional act or omission while attending and participating in the Class.  Under no circumstance will the SOULESTA® Living or their assigns be held liable for my injury or death or any loss of damage of my personal belongings resulting from my participation in the Class. 

Indemnification:

• You agree to indemnify and hold harmless the instructor, any hosting platform, and any other affiliated parties from any and all claims, demands, or liabilities, including attorney's fees, arising out of or in connection with your participation in this Class.

Use of Statements: 

• You agree that the SOULESTA® Living may use your provided statements and feedback in whole or in part, and may edit, modify, or alter the statement for clarity, length, and context, provided that the meaning of the statement is not materially changed. 

Termination:

• The instructor reserves the right to terminate your participation in the class at any time if your behavior is disruptive or unsafe.

Minors:

• If you are under 18 years of age, you must have the consent of your parent or legal guardian to participate in this Class.

Review and Jurisdiction:

These terms will be governed by and construed in accordance with the laws of the State of Texas, the Attendee agrees that any dispute that arises out of or relates to these Terms will be resolved via non-binding mediation in the State of Texas via a professional mediator obtained by SOULESTA® Living and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Texas in accordance with the policies set forth by American Arbitration Association. If any of these Terms of Use are found unlawful, void, or for any reason unenforceable, the provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions. These Terms are subject to change at any time and at the sole discretion of SOULESTA® Living. 

Entire Agreement:

• This waiver constitutes the entire agreement between you and SOULESTA® Living and its instructors regarding your participation in the Class.

Severability:

• If any provision of this waiver is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

By participating in this online chair yoga Class, you acknowledge that you have read and understood this waiver and agree to be bound by its terms.
